General Conditions
J. Martin’s Heating & Cooling reserves the right to reject any request for a contract upon inspection of the heating unit. All contracts are in effect only if service on the heating unit is performed by J. Martin’s Heating & Cooling, or authorized personnel of the company. If service on any contracted heating unit is performed by anyone other than authorized personnel, the contract will be immediately void without any reimbursement of any type.
J. Martin’s Heating & Cooling will perform service as soon as possible under normal conditions. We shall not be liable for any delay or failure to supply such service or material, when such delay or failure is due to conditions beyond our control. In no event shall we be liable for any consequential damage or injury.
Repairs necessary because of an “Act of God,” flooding, water or other fluids leaking on to burner or controls, inadequate oil or gas supply, or any other abnormal cause are not covered under service contract.
This agreement does not cover any plumbing work such as repair or replacement of gas piping, steam piping, water piping or piping to any part of the domestic cold or hot water system; coils, water tanks, radiators and humidifiers; and electric wring to and from the heat unit.
The low water cutoff on some units must be flushed regularly by the owner to prevent sediment form affecting its operation. Units with air filters are the customer’s responsibility.
Charges will be made to the customer when any of the following conditions exist:
Customer has been informed that they are responsible for their oil storage unit and oil lines.
We at J. Martin’s Heating & Cooling will assume no responsibility for any oil leakage.

- Start up service from an empty oil tank.
- Unnecessary emergency calls involving no malfunction of equipment.
- When emergency or burner switch is found in the OFF position and this is the only reason the unit did not function.
- When circuit breaker is off, or fuse is blown.
- When room thermostat settings are below room temperature, or switches are set improperly.
- When someone other than our own personnel changes setting on controls.
- Plugged nozzles and oil filters.
Customer has been informed that they are responsible for their oil storage unit and oil lines.
We at J. Martin’s Heating & Cooling will assume no responsibility for any oil leakage.
